Deck Permits in North Carolina
Decks are one of the most common residential projects in NC — and one of the most common sources of building code violations. Here's what you need to know before you build.
When a Permit Is Required
Most North Carolina jurisdictions require a building permit for any deck that is:
- Attached to the house (ledgerboard connection)
- More than 30 inches above grade at any point
- Part of a new home construction
- Located in a regulated buffer or watershed area

When You Need Sealed Engineering Plans
The North Carolina Residential Code (based on the IRC) includes prescriptive deck construction provisions — meaning if your deck follows the code's standard details, you don't need engineered plans. But sealed engineering is required when:
- The deck exceeds prescriptive span limits — posts, beams, or joists outside IRC tables
- The deck is elevated — typically over 8–10 feet above grade
- Cantilevered or multi-level designs — non-standard framing configurations
- The deck supports a hot tub or pool — additional live loads exceed prescriptive capacity
- The ledger attachment is non-standard — brick veneer, stucco, or ICF walls
- The deck is commercial — restaurants, bars, multi-family buildings
Common Code Violations
The most frequent deck failures we see in NC:
- Improper ledger attachment — using nails instead of lag bolts or through-bolts; missing flashing
- Inadequate post-to-beam connections — notched posts without proper hardware
- Insufficient footing depth — NC frost depth is 12" minimum, but local conditions vary
- Missing hardware — joist hangers, post bases, and lateral load connectors
- Improper stair stringers — cut stringers with excessive notching
